remains a consistent issue throughout the United States (U.S.). 7 Infertility and impaired fecundity affect women between the ages of 15-49, including 13.4% overall and 16.3% of married women. 8 It is especially emphasized among married women who have no prior births as 26.0%experience impaired fecundity and 19.4% of overall experiences of infertility, in comparison to just 6.0% of mothers who have had multiple children. 9Surrogacy, therefore, is a technology that addresses the negative socio-cultural expectations surrounding parenthood and who fits the normative standard of being a parent. 10 Although surrogacy has many positive aspects, the difference in its domestic application raises complex ethical and legal concerns that could be resolved through a bioethical framework that emphasizes autonomy and justice.This paper proposes a federally subsidized program to address inconsistencies in state legislation on surrogacy agreements.Drawing on New York's Surrogates' Bill of Rights and an amended Uniform Parentage Act, it aims to implement a standardized surrogacy framework that incorporates key bioethical protections when forming surrogacy contracts.The program would also incentivize states to encourage a more collaborative relationship between surrogates and intended parents, safeguarding the autonomous rights of both parties, moving beyond a purely contractual transaction.This paper further explores the legal and ethical implications of commercial surrogacy agreements that lack sufficient bioethical safeguards.It highlights the potential risks of exploitation, power imbalances that compromise informed consent, and the inequitable access to nuclear families, which is limited to the wealthy class.Part II provides an overview of the different 7
