Original abstract

Sociolegal scholars have thoroughly documented how marginalized accused are managed in urban judicial systems, yet issues related to non-urban criminal courts remain relatively underexplored. Drawing on interviews with legal aid and private defence counsel working in Ontario and Quebec, Quirouette and Batista explore different notions of the “non-urban” in relation to legal practice, and the challenges particular to rural, remote and fly-in communities. They identify common themes in these challenges, specifically discrimination, geographic remoteness, resource shortages, and systemic efficiencies. Finally, Quirouette and Batista outline the strategies used by defence counsel in response, highlighting the relevance of local (un)familiarity, interpersonal relationships, and informal networks.
